I'm glad I didn't leave positive feedback on ebay for TCM! In fact I'm starting to think I might complain to ebay. Auctioning stuff you don't have is pretty naughty.

Meanwhile, it's now available considerably cheaper elsewhere, including Amazon, where as of this moment it's sitting in their Top Fifty albums. smile

I just complained about my auction via PayPal. Let's see what happens. I tried more than once to contact the seller. If TCM is not yet available ok, I understand it and will wait for. But I also bought N12 from him AND payed also the shipping costs for it. So if this seller is not answering my mails or shipping N12 to my address separately, he is forcing me to do this. It is sometimes understandable if something goes wrong, but on the other side my "PayPal-insurance" runs out in a few days, then there is no money back from them...
A simple mail for clarifying things from him would be enough...

I understand you complaining through PayPal BV, but if you are unhappy with the way the seller has conducted his business, it would also perhaps be an idea for you to contact ebay (the site where you purchased the item through) to let them investigate and advise the best course of action for non-replyers I would think.

Firstly i think its best to say i still have no contact with this 'seller', so im speaking in genaral terms.
As 'he' seems to not reply to anyones emails im beginning to think he was not caught out by a change in release date.
Ive had some strange times on ebay with other sellers, it seems to happen that way, but rarely.
This is starting to look that way, due to no replys.

@ E.G.: You are right, but I think PayPal is the better way. There is little bit more pressure behind it, because they have to pay me eventually at the end. So it is simply a reason for them to get active. The following actions are now more hidden and have not immediately impact to his official ebay-profile until my complain is solved. Let me explain why I did it this way:

Believe me, I can understand if something goes wrong when you're the seller. Same happened to me when I went to the hospital for an operation. During the time I was there, I had no chance to show some reaction on my running auctions or to reply. Then things went very fast wrong after already a week. Negative feedbacks, really ugly mails and so on. Only some people asked friendly what went wrong. Finally I had a little dance with eBay to correct all what automatically happened then with my profile. As soon as I could I contacted then "my customers" put some goodies into the packages, apologized and so on. And I have to say: Some people apologized also in a very nice way for their reactions after they got knowledge about the truth. Together we all found a way to make it a happy ending. But here in this case, more than 4 weeks not replying to mails needs some action. This seller has until now only a few negative feedbacks. I know how hard it is to get such a good profile on eBay, negative feedback would help nobody if there is a good reason for his silence. And I am sure there is a good reason. You see, I am more on the optimistic site...

Hi BV,

I agree with you in part, but the problem is that your transaction will be bound by the ebay codes and resolutions, not by PayPal (which although part of the group is a seperate entity). If it is the issue about money, and getting it back, then yes, you will get your money back through PayPal if the seller defaults. But your contract for purchasing the item is through ebay - I'm not sure PayPal will get involved if it is a 'contract not being completed as advertised or sold' issue rather than a financial dispute.

Also, if this seller carries on like he seems to be, negative comments via ebay feedback do give people a good idea of the trustworthiness of the seller and do make a difference in how customers are treated in the future. If I recall correctly, the seller of the album is a business rather than an individual, so it perhaps makes it even more damning his lack of communication. If it was a high street shop, any complaint that wasn't listened or responded to through thier own processes would be subject to being taken through consumer channels, laws and perhaps publicity rather than an individual writing to the companies bank asking them to refund monies for something one of their clients had done.

Anyway, I think I'll wait until the album hits Amazon properly...

Sheer impatience for new music from John prompted me to bid on the CD. But, having bought Nation 12 from the same seller I had faith. Of course back then I was assuming the CDs were ready.

So to discover that he was selling CDs that hadn't been made yet, AND promising an early delivery date is really unacceptable.

Should have waited for Rob's official and reliable word..... I'll never learn!!

I did the optimistic bit days ago BV when i stated the seller may of been let down by the release dates.
The reason i took a more serious view now, is that Alex and yourself have still had no replys.
Negative feedback is one thing, but he could be pretending to sell even more expensive items under another user name and account by now.
Its not my place to complain to the seller as ive not bought from him. Im just trying to help ultravox fans and other ebay users. I will probably be one of the first to get a copy myself, but even that is a while still. So you can imagine how much trouble these kind of 'sellers' cause, given the time frame.

Like I said I trust him from previous experience - obviously the information he had changed, dates got put back etc, which was of course, beyond his control.

However since we had already paid, some communication would have been nice!!

I'm sure he'll deliver the goods as soon as he has them, but his poor communication isn't going to get him any good feedback from me, unless I have a coherent reply in the meantime.

I have to admit, despite having bought a lot of stuff from E-Bay, I'm always a bit weary, but this is the first time I've had any problems.

I have absolutely no problem with buying stuff from Amazon or HMV or all your other sites for CDs and DVDs - you get them quick and much cheaper than in the shops - which is my main purpose for doing so. Never had any bother. E-bay could often be a different kettle of fish I imagine.

I think i discribed record lebels as like houses in a street. Im kind of a 'just' insider. You could say i walk the streets. From that position you dont always hear things correctly, hence the nation 12 mix up i helped to make.

Sorry for using this thread again for this. Somebody of you complained already? If not, the interesting fact is that if you want to "tell" eBay about a probably non-trusty-seller and you payed via PayPal, you will guided automaticaly to PayPal. wink
So I think more and more people will complain in this way. You are right about your thinking with the negative feedbacks. But this has only the taste of revenge for me. Does it really help others? This seller has so many good feedbacks, I think my single negative feedback will get then interpreted by others more in an other way: "Look this guy can't read, the seller told about the delivery-date in the future." Don't forget, I not from the UK...
So I simply want to prevent other friends of John's music here on the site to do this via this seller at eBay and give them a warning. I am sure I will get the CD's or my money back. However I would like to hear N12! This is giving me frustration mad , it's not about loosing money, it is because I have to wait and to wait and to wait....

well, maybe a bit of perspective is in order i bought the nation 12 album off him and the service was excellent. i dont think he can really be blamed for the delay to the album, just being a little slow to reply and that's not the biggest crime in the world. he has now answered your email and told you when you are likely to expect the album. i would just hold on and see if you get it when he says you will and then judge the overall service.

Hurrah! I must defend myself tho and state quite clearly that I didn't BEAT you to the Nation 12 CD. I ordered it from them once it was on general release I think just before Christmas and as a result they got three copies in. One for me and two on the shelves. They have long since disappeared and were available under "John Foxx".
The album I saw a week ago was on the shelves under "dance" - it might even be still there for all I know. I was looking for Aphex Twin stuff at the time, and just happened upon it.
I should have bought it, and offered it for sale online I think!!

How are the "real" charts calculated these days? Are they properly weighted to reflect the different ways that people buy records: store, mail-order, e-commerce, download, etc.? I wonder how many sales TCM will need to make the "real" album chart?

Just occurred to me that I wondered a while back whether "Kurfurstendamm" would have the umlaut or not - and now we hear that the release has been delayed because they're reprinting... coincidence? wink

This would be a funny mistake. I assume you don't use umlaut's like , , or in UK ?

This is the same thing for the Ultravox concert in 1978 at ONKEL P. I often found it written as ONKEL PO - but PO is another short name for (sorry) BUTTOCKS lmao in Germany. So PO and P are completely different words...

But I have the same problems with English Speech sometimes...

No probs, BV. I hope you do receive it from the ebay-er very soon (pre or post world cup final!). As a taster, why not go to Johns myspace page (which has been mentioned on another thread), and take a listen to 'Your kisses burn', which IMHO, is one of the best songs on the album.

Well, it's very much as described, a bit of retro electronic music. A missing mid-70s Kraftwerk track, or a bit of incidental background music by the Radiophonic Laboratory for an old Doctor Who episode... it doesn't have the relatively subdued and stark beauty of "Glimmer," but perhaps there'll be something closer to that on TCM.

If TCM is pretty much all like "Looped Los Angeles" I'll probably enjoy it, though I won't necessarily consider it one of his more important works. But hell, considering the long drought from the mid '80s to the mid '90s I'm glad that he's putting out a good number of albums and taking a few different creative approaches along the way.

The more john foxx cds the better for me.
With John its always been quality so this track is just a taster. Like 'nightlife' on modern art, was impoved on by the time 'pleasures'.. came out.

TCM is a 15 track instrumental album, but will still be brilliant.... as its from John!

CD Wow have got the release date down as 22nd May and it is only costing 9.99 including delivery. So if you bought it from the geezer on Ebay (like I did) it's looking like a bad purchase especially when he's had our cash since the end of March. Never again!! frown

It's even more galling when we were supposed to get the CD two weeks before official release. Mind you, which "official" release date do you believe??

Just to "bring my special problem to an end". I got my money back via PayPal. But they told me no details about the unprofessional behave of the seller in my case. What now?
I think I will wait a little bit more, maybe I can enhance my NUMAN-collection now or buy the remastered FoxxVox-CDs with the returned money. So if somebody else had the same problem, complain via PayPal and you will get your money back. Every cent.

Just to say, I understand that you can't have total control over ebay. but i was under the impression that Fulfill records was a known and recognised 'friend of the site' as it were. I also was under the impression (wrongly or rightly) that this guy ran a record shop, so why can't we go visit?? How can he justify having our money for so long (especially old BVs - BTW the offer to do you a copy of 'Electrofear' still stands). Now, I would much prefer to buy my JF releases through EV or Metamatic if we got a statement to give an official response along the lines of 'Don't buy from ebay/one man and his dog distribution/etc, we will sell them on the site as soon as they come out'.
I think Rob and Cerise are very good at giving us info when they hear of it, but are probably just as much in the dark as us, and some of the titbits of speculation coming from some quarters on these threads do more harm than good (I think those guilty probably don't even know who I mean -judging by some of the comments).
Who remembers the good old days, when you used to walk down a 'road' to the independent 'record store' (anyone remember them - probably where a bloody 'Starbucks' is now!!!!), and flicked through a shelf full of big black things with holes in 'em, covered in 'cardboard' and 'paper', you got your new John Foxx 'Record' and paid the bearded bloke behind the 'counter' with 4 'ONE POUND NOTES' and got one penny back! (to spend on space dust!)
Ebay? internet shopping? Online account? Downloads? I Pods? My arse! If Mr Fulfill records will give all the interest he's earnt from our money since March to charity, I'll forgive him!

Must agree mostly with this, it did feel better to just go to a shop and buy whatever was on the shelf. Simple as that.

I can understand to some degree though, that fans will speculate on new items, as this can be part of the excitment.

Mr Fullfill should simply NOT have been allowed to advertise this CD for sale over 2 months prior to its release. He should not have charged people for CDs that were not even pressed at the time.

The only thing that's stopping me from trying to get a refund and wait to buy the CD on official release from a proper seller, is that I simply can't be bothered with all the faffing around!!
